General Terms and Conditions of Use (CGU)

1. Preamble

The user of the Connect application (hereinafter: App-Connect) declares to have read and accepted these General Terms and Conditions of Use (hereinafter: CGU or T&Cs) before accepting any contract with CONNECT Association Non-profit.

Welcome to App-Connect, CONNECT Association’s mobile and online service.

The domain name www.app-connect.org (hereinafter: website) and the App-Connect mobile application (Connect or Connect App) are owned and managed by CONNECT Association, a Non-profit organization, incorporated and existing under the laws of Switzerland and having its registered office at 1807 Blonay, Vaud.

The purpose of these T&Cs is to regulate the rights and obligations related to the use of the platform.

App-Connect should not be used by persons under the age of eighteen (18) years.

If you have some suicidal thoughts or if you plan to act on them, or if you think you may be a danger to yourself or others, or if you have a medical or mental health emergency or serious mental health condition, or if you are in a crisis or trauma or abuse, please stop using the service immediately and call the appropriate emergency number in your country and notify the police or emergency medical services. For example, you can find your country-specific suicide hotline at www.suicide.org (Suicide Prevention, Awareness and Support).

App-Connect's services are not intended to replace face-to-face psychotherapy or to provide a diagnosis, prognosis, treatment or cure for any disease, condition, disorder or disability, or to provide any type of state-regulated mental health services in your country of residence. It is an enabling and empowering mode of support, rather than a treatment of illness or health condition.

The contact persons with whom App-Connect Users communicate are not therapists and are not authorized to act/interact as such. They do not provide medical advice or diagnosis. If you mention the need for such advice, they will suggest you to seek advanced (medical) help and they will redirect you to medical professionals outside the App-Connect application.


2. Goals

2.1. CONNECT Association, through App-Connect, aims to promote the emotional and mental strength of the population and to help reduce the number of people suffering from burnout or depression. App-Connect also provides a virtual space of support, encouragement and community with the aim of avoiding loneliness, helping people to remain emotionally stable as well as moving towards a healthy state of mind. Ultimately, the goal is to equip Users with skills to better manage and overcome life's challenges.

2.2. App-Connect offers tools to help Users learn more about mental well-being and better manage their emotions. It offers up-to-date content, courses, and engaging articles on a wide variety of topics to nurture general human needs and prevention factors. Through the various courses on many topics, App-Connect provides information and exercises allowing Users to build and maintain a healthy state of mind.

2.3. It is also a virtual place of sharing, support, inspiration and encouragement for Users. App-Connect aims to provide a “safe and anonymous space” to build community, to connect, interact and bond. Its goal is to connect people who are going through similar difficulties, support them and help them move forward in life and live happier lives. App-Connect makes it easy to find resources, information, articles, links and tips on topics like stress management, how to be happy with yourself, how to build self-esteem, how to deal with loneliness, etc. It is also a forum for sharing, a space to give, encourage and support. App-Connect is a preventive actor, helping to find a balance in life before developing a critical situation, or a severe emotional disorder.

2.4. App-Connect is not designed to help mental health issues and crises. No medical advice, treatment, therapy, diagnosis can be given on this app or made through the app. App-Connect does not give any advice (medical or professional) on therapies, treatments or otherwise, but redirects people in need to health professionals, therapists, clinics, hospitals, emergency call centers, etc.

4. Acceptance and modification of the general conditions of use

4.1. These Terms of Service apply to all visitors, data subjects and others who access the service (hereinafter: User(s) or You). This page explains the terms on which you may use our website, your use of the mobile software application, and more.

4.2. By using the App-Connect application, you agree to comply with and be bound by all the conditions described in these T&Cs. If you do not agree to all of these terms, you are not authorized to use App-Connect.

4.3. You also consent to the collection and use of your information as set forth in the Privacy Policy. For more information regarding the use of your data by App-Connect, please read our Privacy Policy.

4.4. CONNECT Association reserves the right to modify, at its sole discretion and at any time, these General Conditions of Use and the specific conditions of use specific to certain services. It is up to each User to consult them regularly at the internet address www.app-connect.org in order to stay informed of any changes. The Registered User may also be notified by email.

4.5. By using the App-Connect platform, the User acknowledges that the simple publication of the revised General Conditions of Use on it is sufficient to make them binding on him. If the User continues to use the platform after a modification of the General Conditions of Use, then it implies his acceptance of these.

4.6. The failure of the user to exercise or apply a right or a provision of these General Conditions of Use does not entail any waiver of this right or this provision.

4.7. If a provision of these General Terms and Conditions of Use should be totally or partially invalid/and or unenforceable, the validity and/or application of the other provisions or part thereof shall not be affected. The inapplicable and/or void provisions will then be replaced by legally valid provisions that are as close as possible to the legal meaning of the inapplicable and/or void provisions. The same applies in the event of a gap in the regulations.


5. Creation of a User profile and login credentials on the Site and/or on the App-Connect Application

5.1. The User is invited to fill in the fields indicating his email address and a password (hereinafter his "login data"). In the same form, the User is invited to consult and print these T&Cs to which he must adhere by clicking on "Login".

5.2. Registration is free.

5.3. App-Connect should not be used by persons under the age of eighteen (18) years.


6. Profile management and obligation of sincerity

6.1. When registering, the User agrees to provide truthful information and valid contact details. However, if an error is made, the User may at any time click on the "Account" link of the application in order to access the fields allowing him to correct the data and then save them.

6.2. The login and password allow access to App-Connect services as well as account settings. These connection data are strictly personal and confidential and must not be communicated or shared by the User with third parties. The User is responsible for the management, confidentiality and retention of this data.


7. Privacy

7.1. It is strongly discouraged to share your personal data (such as full name, date of birth, gender, contact numbers, address, financial IDs, etc.) or your medical data as well as any other sensitive data (such as your sexual preferences, religious or political views, financial data, etc.) when you use the App-Connect app and services.

7.2. Contact persons on the application are not authorized to disclose the information exchanged during conversations with Users.

7.3. For security reasons, the User should keep the conversations conducted within the framework of the App-Connect private.

7.4. The User should configure the automatic update of the App-Connect application in the settings of the application manager of his mobile device, in order to obtain the latest functionalities and corrections. It is necessary to always leave the App-Connect version of their mobile device before upgrading to a newer version to prevent the loss of current or previous conversations.

7.5. The User is solely responsible for all actions he takes on his account.

7.6. The User undertakes to immediately inform the CONNECT Association of any fraudulent use made of his account.


8. Warranty and Liability

8.1. The CONNECT Association does not guarantee that the App-Connect services will be usable if the user's Internet service provider fails in the performance of its own service. Similarly, where applicable, the use of applications for smartphones subscribed by the User directly from the application provider assumes that the latter has a smartphone and a satisfactory connection.

8.2. Under these conditions, CONNECT Association is not responsible for non-functioning, impossibility of access, or poor conditions of use of the sites attributable to unsuitable equipment, internal malfunctions of the access provider of the User, to the congestion of the Internet network, and for all other reasons external to CONNECT Association having the character of a case of force majeure as defined by the Swiss courts.

8.3. CONNECT Association does not provide any assurance or guarantee as to the continuous and undisrupted availability of the application, nor as to the accuracy and completeness of the information.

8.4. CONNECT Association declines all responsibility for losses and damages that may arise from the use or consultation of the application or from links to other sites.


9. Eligibility

9.1. You may use the App-Connect service only if you are a natural person, if you accept this agreement and if you agree to form a binding contract with CONNECT Association, and only in compliance with all local, national laws, rules and regulations. and international laws applicable in Switzerland. It is strictly forbidden for anyone under the age of 18 to create an account and/or use the App-Connect service.

9.2. CONNECT Association reserves the right to refuse access to the Service or to terminate/delete your account if the eligibility conditions are not met, respectively if the rules of use are not respected, at its sole discretion. The Service is not available to Users previously removed from the service by the App-Connect.


10. Utilization acceptable

10.1. You agree not to access the App-Connect Service or use App-Connect in any unlawful manner or for any unlawful or illegitimate purpose or in any manner that violates these Terms. You must not post, use, store or transmit:

10.1.1. a message or information under a false name;

10.1.2. material that is unlawful, defamatory, obscene, fraudulent, predatory of minors, harassing, threatening, hateful, or otherwise offensive to any person; Or

10.1.3. information that infringes or violates the intellectual property rights of others or the rights of privacy or publicity of others.

10.1.4. You must not attempt to interfere with the operation of the Service by any method, including the use of viruses, Trojan horses, worms, time bombs, denial of service attacks, flooding or spam. You will not use the service in any way that could damage, disable or impair it. You must not attempt to gain unauthorized access to User accounts or computer systems or networks, through hacking, password mining or any other means. You must not use any robot, scraper or other means to access App-Connect for any purpose.

10.2. Please do not share your personal data (such as last name, first name, date of birth, gender, contact numbers, address, financial identifiers, government provided identifiers) or your medical data or any other sensitive data (such as your sexual preferences , your religious or political opinions, your financial data) when communicating with other Users.

10.3. The following terms apply to any app you access through any source (such as the Apple App Store, Google Play Store or other similar platforms) where the app is made available (each of these distribution platforms being an "application provider"). You acknowledge and agree that:

10.3.1. These General Conditions of Use are concluded between you and CONNECT Association, and not with the application provider, and that CONNECT Association (and not the application provider), is solely responsible for the application; and that the Application Provider shall have no obligation to provide any maintenance and support services with respect to the Application any claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any guarantee will be the sole responsibility of CONNECT Association.

10.3.2. If you download App-Connect, either as standalone software or a browser plugin, you agree that from time to time the software may require you to download upgrades, updates and additional features that we release to improve, strengthen and develop the software, the service or the App-Connect. The Service may be changed from time to time and/or the App-Connect may cease (permanently or temporarily) to provide the Service (or features of the Service), possibly without notice.


11. App-Connect accounts

11.1. The creation of an account via registration is necessary in order to create a secure space where the Internet user can find all his information and conversations. It is possible at any time to modify your information in the account settings section. The account can also be deleted at any time. Your data will be deleted and you will no longer be able to access it. In this case, the data collected will then be deleted after the last statistical analysis of the App-Connect but at the latest within 6 (six) months. The App-Connect will notify you of changes that impact you if and when they occur.

11.2. When creating your account, if necessary, you must provide accurate and complete information. If you provide false, inaccurate, outdated or incomplete information (or which becomes false, inaccurate, outdated or incomplete), or if we have reasonable grounds to suspect that such information is false, inaccurate, outdated or incomplete, we have the right to suspend or terminate/delete your account and to refuse any current or future use of the service (or any part thereof).

11.3. To confirm the creation of the account, the User must click on the confirmation link that he will receive on the e-mail address that he will have indicated at registration or confirm his registration via the procedures specific to Google, Apple or Facebook.

11.4. You are solely responsible for the activity that occurs on your account, and you should keep your account password safe. Whenever you need to set a password, we encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account. You must notify CONNECT Association immediately of any breach of security, any unauthorized access to your chats or other data, or any unauthorized use of your account. CONNECT Association (App-Connect) will not be liable for any loss caused by unauthorized use of the account.

11.5. You should never use another user's account.


12. Account deletion

12.1. You can initiate the deletion of this data at any time via the "data deletion" option in the App-Connect settings; This option allows you to delete:

- comments (post and replies to posts) in the chat;

- progress in the library;

- the daily mood-check-in.

However, the account remains active.

12.2. You can initiate the deletion of your account at any time via "deleting my account" in the settings of App-Connect; All your account data will then be deleted, with no possibility of going back.

12.3. Before uninstalling the app from your phone, make sure you have cleared the cache to remove the data stored on the phone memory. 

For Android, follow these instructions: open settings → applications → app-connect → storage. Click on storage and press the option “delete data” followed by “clear cache. The path may vary depending on the models.

For Apple, follow these instructions: home screen → settings. Select the App-connect application and activate the “clear app cache on next launch” button. The path may vary depending on the models.

If the "clear app cache on next launch" button is not available, it is advisable to uninstall the application and possibly reinstall it if you wish to continue using it.

12.4. If your account remains inactive for more than six months in a row, you will receive a reminder email which will give you a deadline to reactivate your application, otherwise your account and all your data will be deleted.

12.5. You also agree not to share any personally identifiable information, including sensitive information from you. Any information you share will be treated in accordance with the Privacy Policy.

12.6. You have rights and these can be viewed in the Privacy Policy. If you have any questions, concerns or complaints, please contact us at contact@app-connect.org. The CONNECT Association may ask you for additional information in order to process your request appropriately. Please note that we may need to verify you before responding to any request to exercise your rights.


13. Privacy

13.1. We do not collect any personally identifiable information from you. At the same time, we also use this anonymous data for research and statistical purposes to improve our products and services and contribute to the development of User-centric best practices for mental well-being globally. Please refer to the Privacy Policy for more information on how we process your data.

13.2. CONNECT Association reserves the right to modify or discontinue, temporarily or permanently, any service in or on the App-Connect application, with or without notice to the User. The User accepts that the CONNECT Association shall not be liable to the User or to any third party for any loss, damage or prejudice that may result for the User or a third party from such interruption or interruption of service.

13.3. The services of the App-Connect depend on various factors such as software, hardware and communication networks, its subcontractors and sub-processors. The CONNECT Association does not warrant that the App-Connect service will be uninterrupted or that it will be timely, secure or error-free. The CONNECT Association being a non-profit organization, it operates its application free of charge for all its users, on a voluntary basis. The various software and servers necessary for its operation are entirely financed by donations.

13.4. CONNECT Association, at its sole discretion and for any reason, may terminate the User's participation in the App-Connect services and refuse any current or future use of its platform by Users.

13.5. All conversations and data obtained during the service are confidential. Storage, use, and security of information are governed by the Google Analytics Privacy Policy and Terms and Conditions (see Privacy Policy).

13.6. You accept and authorize the CONNECT Association to collect and process your data in accordance with the terms of our Privacy Policy.

13.7. You understand that the use of technology is not always secure and you accept the technological risks when using your mobile device. You will follow good security practices when using digital. You understand and agree that safe use is your responsibility, and the CONNECT Association will not be liable in any way for unauthorized access to your forum interactions or any other data.


14. Dispute Resolution and Disclaimer

14.1. In the event of a dispute of any kind, the parties undertake to undertake mediation with a neutral mediator chosen by CONNECT Association. In the event that the mediation process does not result in an agreement between the parties within a period of at least 360 days, each party may refer to the judicial authority referred to in art. 17.2. of these Terms of Use. The parties agree that the dispute is subject to Swiss law.

14.2. Connect assumes liability only for its own acts and for direct damage resulting from willful intent or gross negligence. Connect's liability for direct damage caused by slight negligence is expressly excluded. Furthermore, any liability of Connect for consequential damages is expressly excluded.

14.3. Connect assumes no responsibility in connection with temporary accessibility problems of the application or the website. Connect plans its maintenance of the application and the website in such a way as to limit the inconvenience for Users as much as possible, but without being able to guarantee access at all times.


15. Intellectual property

15.1. The content of the platform may not be used, reproduced, distributed, transmitted, broadcast, represented, sold, assigned or otherwise exploited for any purpose other than its consultation and use on said platform in accordance with these General Conditions of Use. use.

15.2. If the user wishes to establish a link to the platform, he undertakes to request the prior and express authorization of CONNECT Association.

15.3. He will undertake in particular and expressly to:

15.4. The link to the platform does not in any way constitute authorization for the use of the content, name, logo, image or brand of Connect. Any such use requires the prior express, written and specific authorization of Connect.

15.5. Connect reserves the right to request, at any time and without giving reasons, to remove any link to the platform.


16. Links to other sites

16.1. CONNECT Association declines all responsibility and provides no guarantee as to the accuracy, content or operation of the sites accessible via a link from its platform. 

16.2. In particular, it is recommended to carefully read the legal notices and the notice concerning the protection of personal data of all the sites to which the platform may refer.


17. Jurisdiction and applicable law

17.1. The parties agree that their entire relationship in connection with the use of the app (contractual; tort; data protection) shall be governed by Swiss law.

17.2. Any dispute is subject to the exclusive jurisdiction of the District Court of Lausanne, subject to the prior mediation procedure provided for in art. 14.1 of these Terms of Service.

17.3. In the event of a dispute, or claim by the User arising from or relating to these General Terms and Conditions of Use, the User undertakes to make every effort to settle the dispute amicably.

17.4. The French version of the General Conditions of Use prevails.

Privacy Policy


1. Preamble

1.1. This Privacy Policy contains information on data processing of personal data, contact details, statistics, electronic newsletter, website statistics, etc.


2. General

2.1. The following information is intended to show you what data we process on our app and what your rights are in this regard. The protection of your personal data is very important to us and we treat your personal data confidentially and only in accordance with legal provisions.

4.1. The use of the App-Connect application requires the indication of general personal data such as an age group, an e-mail address, a gender or even a place of residence. The collection of some of this data is not mandatory. 4.2. The processing of personal data, such as name, address of a data subject, is always carried out in accordance with the applicable legislation. Through this data protection declaration, CONNECT Association wishes to inform Users about the type, scope and purpose of the personal data that we collect, use and process.

4.3. With regard to the processing of data and information, CONNECT Association has implemented numerous technical and organizational measures to ensure the most complete protection possible of the personal data processed via the application and the website. Nevertheless, data transmissions over the Internet can generally have security gaps, so that absolute protection cannot be guaranteed. This is why any User concerned is free to transmit personal data to us by other means, such as by telephone.


5. Collection of general data and information and creation of log files

5.1. When you access our website, the page provider automatically collects and stores  information in server log files, which your browser transmits to us.

5.2. The following information is recorded:

– Types and versions of browsers used

– the operating system used by the access system

– the user's Internet server provider

– Access computer host name

– Date and time of server request

– The IP address of the user

5.3. This data cannot be attributed to a specific person and there is no consolidation of this data with other data sources. Log files are stored to ensure the functionality of the website as well as the CONNECT Association application and to ensure the security of our IT systems. The data is only kept for as long (but a maximum of 6 months) as is necessary to achieve the purpose of our collection. The storage of log files is absolutely necessary for the operation of the website, you therefore have no possibility of objecting to this.


6. Use of cookies

6.1. Our website uses cookies. Cookies are text files that are stored on the operating system of your device using your browser when you visit our website or app.

6.2. We use cookies to make our website and our application more user-friendly. By storing cookies on your device, we can recognize your browser when you visit the site again. This allows us to save certain settings so that you do not have to re-enter them when visiting the website or application.

6.3. Cookies are stored on your computer. You therefore have full control over the use of these. You can delete them completely or disable or restrict their transmission by changing the settings of your Internet browser. 7. Use of App-Connect

7.1. With the following information we would like to inform you about the content of our app as well as the registration, sending and statistical evaluation procedure and your rights of objection. By creating an account on our application, you agree that your data will be processed for statistical purposes.

7.2. The personal data collected on the App-Connect will be used for statistical and survey purposes, as well as for the proper functioning of the system. In addition, the Users of the application could be informed by email if this is necessary concerning the operation of the App-Connect or for their registration, as could be the case in the event of a modification of the offer of the App-Connect or change of technical conditions.

7.3. The personal data collected as part of the creation of an account on the application will not be transmitted to third parties.

7.4. A User's account may be deleted by the person concerned at any time. The consent to the storage of personal data, which the data subject has given us by registering for the App-Connect, can be revoked at any time. To revoke the consent, a corresponding link is included via the "data deletion" option in the settings of App-Connect. It is also possible to unsubscribe from the App-Connect by informing the data controller by email: contact@app-connect.org.


8. Content of CONNECT Association communications

8.1. We do not send newsletters, e-mails and other electronic notifications containing advertising information. We only contact our Users in the event of changes to the General Conditions of Use, changes to the Privacy and Data Processing Policy or during surveys aimed at obtaining their opinion on the use of the application. We may contact our Users in the event of any problems  encountered while using the Connect application.

8.2. Double-Opt-In et connexion : Registration for the App-Connect application is done according to a so-called Double-Opt-In procedure. This means that after your registration (email and password) you will be invited in the "Account" section of the application to click on a button in order to receive an email. This one contains a link to click in order to validate the email address. This confirmation is necessary so that no one can register with foreign email addresses. Registrations on the App-Connect app are recorded in order to be able to prove that the registration process complies with legal requirements. This includes storing the registration and confirmation time as well as the IP address. Changes to your data stored by our shipping service provider (Firebase) are also logged.

8.3. Registration data : To create an account on the App-Connect, simply enter your email address. Optionally, we ask you to enter a name so that we can address you personally on the application and allow you to participate in discussions on the forums of the application.


9. Routine deletion and blocking of personal data

9.1. The controller processes and stores personal data concerning the data subject only for the time necessary (maximum 6 months) to achieve the purpose of storage or when this is provided for by the European Directive and Regulation or by any other law or regulation to which the controller is subject.

9.2. If the purpose of the storage ceases to apply or if a storage period prescribed by the European Directives and Regulations giver or any other competent legislator expires, the personal data will be blocked or deleted systematically and in accordance with the legal provisions.


10. Your rights as a User

10.1. Below is a list of your rights in relation to the data you process.

10.1.1.Right to confirmation
Any user concerned has the right to obtain from the controller confirmation that personal data concerning him are being processed.

10.1.2.Permission to access
You can request confirmation that personal data concerning you is being processed by the CONNECT Association. If this is the case, you can request concrete information about the processing free of charge.

10.1.3.Right of rectification
If a User concerned wishes to exercise his right of rectification, he may at any time contact the data controller to obtain the rectification and/or addition of the personal data concerning him. This can also be done from the “Manage My Account” section on the app.

10.1.4.Right to erasure
Each User may request the deletion of personal data concerning him. The data will be deleted if the required conditions are met. The right to erasure cannot be granted if the processing is necessary for the exercise of the right to freedom of expression, the fulfilment of a legal obligation or a task carried out in the public interest or for the assertion, exercise or defense of legal claims.

10.1.5.Right to restrict processing
Each User may request the limitation of the processing of his personal data if he disputes the accuracy of this data, if the processing is unlawful, if the data is no longer necessary or if he opposes it. If data processing is restricted, data may only be stored for 6 months. Further processing may only be carried out with your consent, for the purposes of asserting, exercising or defending legal claims, protecting the rights of another person or for reasons of important public interest. We will let you know if the restriction is lifted.

10.1.6.Right to data portability
Each User has the right to obtain the personal data concerning him which is based on consent, on a contract or on processing using automated procedures, in a structured, common and machine-readable form and to transmit this data to a third party. Insofar as technically possible, the User may request direct transmission. The rights and freedoms of other persons must not be affected and the User may also request that personal data concerning him which is incorrect be corrected.

10.1.7.Right of appeal
Each User may object to the processing of data concerning him if it is carried out on the basis of the legal basis for the performance of a public mission or legitimate interests and if he finds himself in a particular situation. Each User may also oppose it if the data processing is carried out for direct marketing purposes. In this case, the data in question will no longer be used for this purpose.

10.1.8.Right to revoke data protection consent
Each User affected by the processing of personal data has the right to withdraw their consent to the processing of personal data at any time. If the data subject wishes to exercise his right to withdraw his consent, he may contact the controller at any time.


11. Data protection provisions regarding the use and application of Google Analytics
